Terms and Conditions for Consumers

§ 1 Contractual Relationships and Liability

  1. Kanzaroo is a payment service through which you can pay for services and other products. InternetQ GmbH (InternetQ) offers Kanzaroo exclusively on behalf of the provider of the products (your contractual partner). Therefore, the use of Kanzaroo does not establish a contractual relationship between you and InternetQ. Insofar as contractual relationships are established between you and InternetQ outside the use of Kanzaroo, these remain unaffected thereby.

  2. InternetQ reserves the right to modify the Kanzaroo payment service at any time, to supplement it with new billing methods, or to discontinue it altogether. InternetQ assumes no liability for the error-free operation and availability of Kanzaroo. Mandatory statutory liability claims remain unaffected.

  3. The contracts regarding the products selected by you are concluded exclusively between you and your respective contractual partner. InternetQ is not obligated to verify the contractual partner or the products selected by you. Therefore, InternetQ assumes no liability for the respective contractual partner and the products offered by them. Furthermore, InternetQ is not liable for the content of the web or WAP pages through which the use of Kanzaroo is made possible.

  4. InternetQ assumes no liability for the misuse of Kanzaroo through your (mobile) phone or your SIM card.

§ 2 Payment Amount and Costs

The amount to be paid is the gross price agreed between you and the respective contractual partner for the product selected by you in the respectively agreed currency. If the sending of SMS messages is required as part of the use of Kanzaroo, additional charges for sending SMS may be billed by your telephone provider. If you use Kanzaroo via (mobile) internet, additional costs (GPRS, UMTS, etc.) for data connections may be billed by your telephone provider. InternetQ does not charge you any separate costs for the use of Kanzaroo.

§ 3 Blocking

  1. Insofar as facts become known that indicate a misuse of Kanzaroo, InternetQ reserves the right to immediately block the affected users from further use of Kanzaroo and to inform the corresponding contractual partner as well as other affected third parties thereof.

  2. However, InternetQ will not disclose any of your personal data without your consent – unless there is a legal, official, or judicial obligation to do so.

§ 4 General Information on Use

  1. Due to the use of different (mobile) internet browsers and individual software settings, deviations may occur in the display of the content.

  2. Kanzaroo is available for the selectable countries. Use of Kanzaroo from other countries is not intended by InternetQ. InternetQ therefore assumes no liability that the use of Kanzaroo is suitable, possible, or legally permissible for users from other countries.

  3. In the case of using Kanzaroo, you remain responsible for ensuring that settlement of the transactions made is guaranteed when due. Please note in particular that use of Kanzaroo may be restricted by individual credit or spending limits agreed upon with third parties (e.g. your telephone provider). The use of Kanzaroo may also be restricted or excluded if the billing method intended for Kanzaroo in an individual case is unavailable (e.g. blocking of a telephone number). If a payment via Kanzaroo is unsuccessful, you remain obligated to pay for the purchased products.

§ 5 Special Information on Use

  1. To use Kanzaroo via SMS, your (mobile) phone or SIM card must be reachable. The payment process starts either with the entry of the telephone number in an input field in the Kanzaroo window, identification of your telephone number on the (mobile) internet, placing a call, or sending a keyword via SMS. Depending on the respective country-specific and/or other legal or technical peculiarities, you confirm the payment via Kanzaroo either by SMS, phone call, clicking on the web or WAP page, or entering a transmitted transaction authentication number (TAN) in the Kanzaroo window.

  2. By completing the payment process, you agree that the payment amount confirmed via Kanzaroo will be collected via your telephone provider. The respective telephone provider will invoice you for this payment amount together with the other charges resulting from the use of the (mobile) phone or SIM card. On the telephone provider's bill, depending on the country from which you use Kanzaroo, either your contractual partner, InternetQ, or another service provider will appear as the payee. Objections to invoice items must be made within the corresponding period agreed with the respective telephone provider. Complaints arising from the contractual relationship with the contractual partner must be settled directly with that partner.

  3. Please enter the telephone number used carefully and verify its correctness before confirmation. As the subscriber, you are responsible for ensuring that no other person uses Kanzaroo via your (mobile) phone or SIM card without your consent. If you detect the loss or misuse of your (mobile) phone or SIM card, please immediately arrange for blocking with the respective telephone provider for your own safety. If your (mobile) phone or SIM card is stolen or misused, please also report this to the police without delay. This is the only way to minimize any potential damage resulting therefrom.

  4. Please note that you may only use Kanzaroo if you are the holder of the corresponding telephone/mobile contract, the fully legally capable holder of the respective prepaid card, or are acting with the consent of such a person. Any abusive use of Kanzaroo is prohibited and may constitute a criminal offense.

§ 6 Data Protection

  1. Data protection is a matter of great importance to InternetQ. InternetQ treats all data entrusted by you as strictly confidential in accordance with applicable data protection regulations.

  2. If you have expressly agreed to receive promotional messages, promotional messages may be sent to the telephone number provided by you. This consent may be revoked at any time by sending an SMS with the content "STOP" to the sender's telephone number.

§ 7 Miscellaneous

Please note that the Kanzaroo payment service and these associated General Terms and Conditions are subject to continuous development and may therefore be amended or supplemented at any time. The current General Terms and Conditions for using the Kanzaroo payment service can be accessed at any time at  www.kanzaroo.com.
